Legislative Decree (49\/2014 RAEE)<\/h1>

What is the RAEE Decree?<\/h3>

The Legislative Decree 49\/2014 \u201cRAEE\u201d assimilates 2012\/19\/EU Directive of the European Parliament and of the Council of 14 Mars 2024, and Directive 2003\/108\/EC on the restriction of the use of certain hazardous substances in Electrical and Electronic Equipment \u2013 Apparecchiature Elettriche ed Elettroniche (AEE). <\/p>

What are the provisions of this Decree?<\/h3>

Starting from 1 September 2007, the measures on the separate collection and disposal of RAEE \u2013 Waste Electrical and Electronic Equipment.<\/p>

What does RAEE stand for?<\/h3>

RAEE means <\/strong>the waste generated from appliances, instruments and devices powered by electricity or batteries, such as: \u00b7 Large household appliances
\u00b7 Small household appliances
\u00b7 IT and telecommunications equipment
\u00b7 Consumer equipment
\u00b7 Lighting equipment
\u00b7 Electrical and electronic tools (with the exception of large-scale stationary industrial tools)
\u00b7 Toys, leisure and sports equipment
\u00b7 Medical devices (with the exception of all implanted and infected products)
\u00b7 Monitoring and control instruments
\u00b7 Automatic dispensers<\/p>

Who is subject to this decree?(Art.3, RAEE Decree)<\/h3>

The Producer <\/strong>The Producer means anyone who: MANUFACTURES<\/strong> or ASSEMBLES<\/strong> and SELLS in Italy electrical and electronic equipment (Apparecchiature Elettriche ed Elettroniche AEE) under his own brand; RESELLS UNDER HIS OWN BRAND<\/strong> and sells in Italy electrical and electronic equipment produced by other suppliers; INTRODUCES in Italy AEE and manages the marketing, even through long distance sales, such as:
\u00b7 import an AEE <\/strong>from any European or other country and sell it in Italy;
\u00b7 import an AEE already distributed in Italy by others<\/strong> and sell<\/strong> it on the Italian market.<\/p>

For RAEE legislation, even the \u201cdistributor \u2013 producer\u201d (eg. ACUS) <\/strong>who resells on the Italian market under its own brand AEE which are manufactured in Italy or directly imported will be considered a \u201cproducer\u201d<\/strong>. The Distributor<\/strong> The Distributor (Reseller) is anyone who, last in the marketing chain, sells electrical and electronic equipment AEE to the end user.<\/p>

What are the legal fulfilments?<\/h3>

The Distributor (Reseller) <\/strong>when supplying new electric and electronic appliances or equipment destined to domestic use, has, among other things, the obligation to the buyer (end user), to collect free of charge, on a one-to-one basis, the used appliance (of same type). Any appliance deemed non-reusable must be assigned by the distributor to the Centri di Raccolta pubblici (CdR) (Public treatment facilities)<\/strong>. The CdR<\/strong> must guarantee accessibility to and functionality of its infrastructure and must permit end users and distributors to assign their RAEE \u2013 Waste Electrical and Electronic Equipment free of charge<\/strong>. At the moment the holding user <\/strong>of a private household AEE (electric and electronic appliance), wishes to dispose of said appliance, it can:
\u00b7 assign it free of charge<\/strong> to a public treatment facility (CdR) in its community (the \u201cecological platform\u201d);
\u00b7 hand it over to the distributor<\/strong> in exchange for a new appliance with the same functions. The Producer must ensure that starting from 1 September 2007 all AEE<\/strong> introduced on the Italian market bear the symbol of the \u201cbarred rubbish bin\u201d<\/strong> in a clear and inerasable way in addition to user information in the instructions.
The producer shall also bear the costs of the operation:<\/strong>
Although the law stipulates the producer’s financial responsibility for WEEE management, the user will in reality also be involved, as a modest portion of these management costs is passed on in the sales price.<\/p>

Acus\u2019 RAEE Policy:<\/h3>

The WEEE directive sets out to reduce the volume of waste resulting from electrical and electronic equipment at the end of its life cycle, while at the same time reducing the introduction into the environment of the hazardous substances forbidden by the RoHS Directive.<\/p>

The standard states that at the end of its life cycle electrical and electronic equipment cannot be dumped but must be managed by a system that provides for it to be collected separately and specifically treated for reuse, recycling, or other forms of recovery for finished products, components, and materials. In this regard, the 2012\/19\/UE directive encourages companies to promote changes when designing products, making equipment simpler to dispose of, recover and recycle. <\/p>

According to the dictates of the WEEE the manufacturer must see to financing the collection and treatment of electrical and electronic equipment at the end of its life cycle.<\/p>

Action Taken<\/h3>

These are the product categories subject to WEEE Directive:<\/p>

\u2013 IT and TLC equipments
\u2013 Lighting equipment
\u2013 Electrical and electronic tools (with exception of large-scale stationary indutrial tools)
\u2013 Monitoring and control instruments<\/p>

According to what is required by D.L. n.49 dated 14\/03\/2014, our products subject to the application of the Directive which are being sold\/transferred\/given to our customers respect the European directive in terms of concentration of hazardous substances. <\/p>

For the codes of the items included in the list, a specific declaration of compliance to the directive can be requested to the customer service staff or the relevant commercial office staff.<\/p>

In implementing the WEEE directive Bespeco Professional Srl has put all the procedures in place for marketing electrical and electronic equipment for the brands it is responsible for marketing:
\u2013 Affixing the crossed out bin symbol and including a specific INSTRUCTION SHEET with all items subject to the WEEE Directive;
\u2013 Entrusting the Cobat with recovery and disposal of material at the end of its life cycle;
\u2013 including the WEEE disposal cost in the sale price of electrical and electronic equipment (non-visible WEEE environmental contribution);
\u2013 Updating the Bespeco pricelist to indicate which of its products are subject to the WEEE Directive;
\u2013 Possibility of handing the WEEE over to the distributor in exchange for a new EEE with the same functions;
